Wills and Probate

A will is a legally enforceable declaration by means of which a person directs the disposal of his or her property after death. Probate is the legal process of settling the estate of a deceased person. Probate occurs with or without a will, and is documented in probate files. In Canada, the administration of wills and estates is a provincial responsibility.
